Mathnasium Center Licensing Canada, Inc. (“Mathnasium Canada,” “we,” “us,” or “our”) is the franchisor for Mathnasium™ learning centres in Canada, which are independently owned and operated franchises. This Policy describes Mathnasium Canada’s practices regarding the personal information collected, used, disclosed, and retained by or on behalf of Mathnasium Canada in connection with our operations in Canada, including information about individuals located in Canada collected through our online and offline services, including the Mathnasium Canada website (accessible at Mathnasium.com/ca or Mathnasium.ca), our mobile applications, and our Mathnasium@home online learning platform (collectively, our “Services”).By using our Services or otherwise providing personal information to us, directly or indirectly, you consent – on your own behalf and on behalf of each individual you represent when using our Services (including a child for whom you are responsible) – to our collection, use, disclosure, and retention of your personal information and the personal information of each individual you represent as described in this Policy and as otherwise permitted by applicable law. If you do not want us to collect, use, or disclose your personal information as described in this Policy, then you may choose to not use our Services. We may change this Policy from time to time. If we change this Policy, we will notify you by revising the “Last Updated” date at the top of this Policy. Please refer to section 18 of this Policy to learn about changes to this Policy.

1. Application of this Policy

2. Scope of this Policy
This Policy explains how and why we collect, use, disclose, and retain your personal information in connection with our operations in Canada. This Policy also describes the rights and choices you have regarding your personal information under our control. In some circumstances, at the time of collection of your personal information, we may provide you with additional information regarding our handling of your personal information.

By providing us with the personal information of another individual, you confirm that they (or you on their behalf and with lawful authority) have given valid consent to your disclosure of their personal information and our collection, use, disclosure, and retention of their personal information in accordance with this Policy.
By using our Services or otherwise providing personal information to us, directly or indirectly, you consent to our collection, use, disclosure, and retention of your personal information and the personal information of each individual you represent as described in this Policy and as otherwise permitted by applicable law.
We may also obtain your additional consent from you in certain circumstances to collect, use, disclose, or retain your personal information for other purposes not described in this Policy. In addition, where permitted by applicable law, we may collect, use, disclose, and retain your personal information without your consent.
By providing us with the personal information of a student, you confirm that: (a) you are the student’s parent or guardian with lawful authority to act on behalf of the student and provide us with the student’s personal information; and (b) you consent, on behalf of the student, to our collection, use, disclosure, and retention of the student’s personal information in accordance with this Policy.
By providing us with the personal information of another adult individual (e.g., an emergency contact for a student) you confirm that the adult individual has given valid consent to: (a) your disclosure of their personal information to us; and (b) our collection, use, disclosure, and retention of their personal information in accordance with this Privacy Policy.
You may withdraw your consent at any time, subject to legal or contractual restrictions and on reasonable notice to us, but then you might not be able to use or obtain the full benefit of our Services. Please refer to section 9(e) of this Policy to learn about withdrawing your consent.
4. Personal Information We Collect & How We Use It
Depending on your interactions with us and your use of our Services, we may collect your identifiers and contact information; personal records; commercial information; Internet or other electronic network activity information; geolocation data; audio, electronic, visual, thermal, olfactory, or similar information; professional or employment-related information, and inferences from other information.
We may use your personal information for some or all of the following purposes as applicable to you and as otherwise permitted by applicable law: (a) providing you with requested Services (including customer care service); (b) communicating with you; (c) marketing, advertising, and promotions; (d) understanding how you access and use our Services; (e) improving our Services; (f) responding to your desires and preferences; (g) auditing, and for research and analysis; (h) to help maintain the safety, security, and integrity of our Services; (i) detecting, investigating, or protecting against malicious, deceptive, fraudulent, or illegal activity; (j) tailoring our content or otherwise personalizing our Services; (k) to help protect the safety and security of students and instructors; (l) to help ensure the quality of our Services; (m) for internal education and training; and (n) as part of our application process for potential franchisees and to manage our relationship with current franchisees.
We may use your personal information to create non-personal information. We may transfer your personal information to our service providers to assist us to use your personal information.
We collect personal information in a variety of ways, and we may combine your personal information collected from various sources (including the Mathnasium learning centres with whom you interact).

5. Information Collected Automatically
As explained in section 4 of this Policy, we collect some types of personal information automatically when you use our Services. For example, we use cookies and other tracking technologies to collect and store information about your interactions with our website, including information about your browsing behavior, and emails. Monitoring.

6. How Long We Keep Your Personal Information

We have no responsibility or liability for the handling of your personal information by any of the persons or organizations to whom we disclose your personal information. The handling of your disclosed personal information by those persons and organizations is not subject to this Policy.
(a) Additional Consents.
We may disclose your personal information in accordance with additional consents (express or implied) that you give during your interactions and transactions with us.
(b) Mathnasium Learning Centres.
We may disclose your personal information to the Mathnasium learning centres in Canada with whom you interact or indicate an interest so that the Mathnasium learning centres may contact or interact with you. Each Mathnasium learning centre in Canada has its own privacy policy. We have no responsibility or liability for how Mathnasium learning centres collect, use, disclose, or retain your personal information.
(c) Legal/Law Enforcement Disclosures.
We may disclose your personal information as required or authorized by applicable law, including to comply with a subpoena, warrant, or court or arbitral order or litigation disclosure obligation. We may also disclose your personal information to law enforcement agencies or other independent organizations if we reasonably believe the disclosure is necessary or appropriate in connection with national security, law enforcement, or other issues of public importance (including tax and regulatory compliance), or if we reasonably believe the disclosure is necessary or appropriate to protect and enforce our legal rights, interests, and remedies or to protect the rights, interests, and remedies of other persons (including the Mathnasium learning centres with whom you interact, and our service providers and customers), including to detect and prevent fraud and other illegal activities, and to enforce any of the terms of use, terms of service, or other agreements that govern access to or use of our Services.

We may disclose your personal information in connection with a proposed or actual business transaction in which we are involved (e.g., a corporate amalgamation, reorganization, merger or acquisition, or the sale or transfer of some or all of our business or assets). However, we will only disclose your personal information to the extent necessary for each transaction.
8. How We Create, Collect and Use Non-personal Information
We may use your personal information to create and collect non-personal information – aggregated or anonymized data that does not relate to an identifiable individual, directly or indirectly. We may use, disclose, transfer, and retain non-personal information in accordance with applicable law.
If non-personal information is combined with personal information, then we will treat the combined non-personal information as personal information for the purposes of this Policy for as long as the non-personal information is combined with the personal information.
9. How We Disclose Personal Information
You have choices about the way we handle your personal information.
(a) Your account information.
If you have an account with the Mathnasium@home online learning platform, you can update or change your personal information in your account using the functionalities available through the Mathnasium@home online learning platform or by contacting our customer service representatives. Some of the personal information in your account is mandatory but other information is optional. You must ensure that all of your personal information in your account is and remains accurate, current, and complete.
(b) Marketing communications.
You can choose not to receive our marketing or promotional emails and text messages by clicking on “unsubscribe” in an email you receive from us or by replying STOP or by clicking on “unsubscribe” in a marketing or promotional text message you receive from us. It may take up to ten (10) business days to register a change to your communication preferences.
Please note that even if you have indicated your choice not to receive marketing or promotional emails or text messages from us, we may still communicate with you by email or text message (if you provide your mobile number for those purposes) regarding your account with the Mathnasium@home online learning platform and your use of the Mathnasium@home online learning platform and our Services (e.g., to send you invoices, receipts, or customer service messages) and as otherwise permitted by applicable law.
(c) Cookies.

If you withdraw your consent to our collection, use, and disclosure of your personal information for purposes that are integral to our relationship and dealings with you or your access to or use of the Mathnasium@home online learning platform or our Services, then you might not be able to proceed with your intended dealings with us or otherwise access, use, or receive the full benefit of the Mathnasium@home online learning platform or our Services.
If you withdraw your consent to our collection, use, and disclosure of your personal information for purposes that are not integral to our relationship and dealings with you or your access to or use of the Mathnasium@home online learning platform or our Services, then withdrawing your consent for those purposes will not affect your access to or use of the Mathnasium@home online learning platform or our Services.
If you withdraw your consent to our collection, use, and disclosure of your personal information, or if you request that we delete our records of your personal information, we may continue to retain and use your personal information: (i) to comply with applicable laws; (ii) to establish, enforce, and exercise our rights and remedies, including to enforce any of the terms of use, terms of service, or other agreements that govern access to or use of the Mathnasium@home online learning platform or our Services; and (iii) for other purposes permitted by applicable law.
10. How You Can Access and Correct Your Personal Information
We will rely on you to ensure that your personal information held by us is as accurate, complete, and up to date as necessary for the purposes for which we use the personal information. You must promptly notify us of any changes to your personal information using the functionalities available through the Mathnasium@home online learning platform, by contacting our customer service representatives, or by contacting our Privacy Officer using the contact information in section 19 of this Policy.
If you have an account for the Mathnasium@home online learning platform, you may access and update your personal information associated with your account using the functionalities available through the Mathnasium@home online learning platform or by contacting our customer service representatives.
You may reasonably request access to your personal information under our control and information about our use, disclosure, and retention of your personal information by submitting a written request to our Privacy Officer using the contact information in section 19 of this Policy. Subject to applicable exceptions and limitations prescribed by applicable law, you will be given reasonable access to your personal information, and you will be entitled to verify the accuracy and completeness of your personal information and have the information corrected as appropriate. You might be required to provide us with information to verify your identity and pay a reasonable fee for access to your personal information. We may decline to process an access request that is unreasonably repetitive, frivolous, vexatious, or impracticable, or if we reasonably believe the requested access would infringe or jeopardize the privacy of other persons, or violate any applicable law or legal requirement, or for other reasons permitted by applicable law.
Depending on the jurisdiction where you reside, you might also be entitled to request the rectification of your personal information under our control if our collection, disclosure, or retention of the information is not authorized by law.
11. Where We Use, Process, And Store Your Personal Information
We and our service providers may use, process, and store your personal information at facilities in Canada and the United States of America. The personal information protection laws of countries other than Canada might be different from the laws of the jurisdiction in which you reside, and might permit the government, government agencies, courts, law enforcement agencies, and security authorities in those countries to access your personal information without notice.
12. Information Relating to Children
We do not knowingly collect personal information from anyone under 18 years of age without first obtaining the consent of their parent or guardian.
If we learn that we have collected personal information from a person under 18 years of age without the consent of their parent or guardian, then we will use commercially reasonable efforts to delete the information unless the parent or guardian provides the required consent or we are required by applicable law to retain the information. If you reasonably believe that we might have any personal information obtained from a person under 18 years of age without consent of their parent or guardian, then please contact our Privacy Officer using the contact information in section 19 of this Policy.
13. Social Features
Our Services may permit you to interact with another website, online service, or social media, such as enabling you to “like” Mathnasium on another website, online service or social media or “share” content from our Services with another website, online service, or social media (collectively, “Social Features”). If you choose to “like” or “share” content or post information using Social Features, that information may be publicly displayed on another website, online service, or social media, and other persons may have access to information about you and your use of the Services. Similarly, if you interact with us through Social Features, we may have access to additional information about you (for example, information about whether you “like” or “follow” our page on another website).
Please note that if you mention or comment about Mathnasium or our Services in your post on another website, online service, or social media, the website, online service, or social media may allow us to publish your post on our Services. Also, any information you post or otherwise provide to another website, online service, or social media is governed by their own privacy policies. You are solely responsible for the personal information that you choose to post or share in those situations. We have no control over, or responsibility or liability for, the use, disclosure, and retention of the personal information that you disclose in those situations, and the use, disclosure, and retention of the disclosed information is not subject to this Policy.
14. Information About Online Chats
Our Services include online chat features to assist with answering questions and providing you with relevant information. If you chose to participate in an online chat, either with a virtual or live agent, the contents of the chat may be recorded and retained as a transcript and used by us in accordance with this Policy.
15. Data Security
We have implemented reasonable measures appropriate to the sensitivity and amount of personal information in our custody or control to help protect your personal information from accidental loss and from unauthorized access, use, alteration, deletion, and disclosure.
